Maximus Service Description

Version 1.0 · Anomalist Enterprise LLC, an Indiana limited liability company

This describes what a Maximus marketing subscription actually covers — the package contents, exactly what our app can reach on your connected accounts, and the rule that nothing publishes without your say-so. It is referenced by your Statement of Work and forms part of it. We may revise it on 30 days’ notice; the version in effect on your order date governs until your next renewal.

This document defines what a Maximus marketing subscription covers. It is referenced by, and forms part of, each Statement of Work that includes a Maximus package. Provider may revise it on thirty (30) days' written notice; the version in effect on a client's order date governs until that client's next renewal.

1. WHAT MAXIMUS IS

Maximus is Provider's AI-powered marketing service: it writes, designs, schedules, and publishes social-media content for Client's business, and reports on how that content performs. Content is generated by Provider's systems under human oversight and published to the social accounts Client connects.

Maximus is a DONE-FOR-YOU service, not a software license. Client's subscription buys the content, the publishing, and the reporting — not access to Provider's tooling, prompts, or models, which remain Provider IP (MSA §4.2), other than the client dashboard through which the service is delivered.

2. WHAT THE PACKAGE INCLUDES

FOUNDING — $100/mo

- Ten (10) Facebook posts per week

- Five (5) Instagram posts per week

- Client review and approval of everything before it publishes (see Section 5)

- The client dashboard, and reporting under Section 8

This is the only package offered at self-serve; larger engagements (additional channels, long-form content, multiple businesses) are quoted separately on their own SOW.

BUNDLE: where the same order includes a Sites website build and a care plan subscription, the first month of the Maximus subscription is at no charge. Discounts do not combine — if more than one applies, Client gets the best single one.

Quantities are per calendar week and do not roll over. A post drafted but rejected by Client counts once re-drafted and approved, not twice; Provider does not meter revisions of its own drafts.

3. ONBOARDING AND THE FIRST WEEK

Onboarding is an intake conversation plus connection of Client's social accounts. The subscription bills from the order date per the SOW; the only free period is the bundle month in Section 2, where the order qualifies for it. [The historical first-week-free offer of the retired platform Terms of Service does not apply at the Founding rate.]

4. CONNECTED ACCOUNTS — WHAT PROVIDER CAN REACH, AND WHAT IT CANNOT

Client connects its own social accounts — for the Founding package, Facebook Pages and the Instagram Business accounts linked to them. By connecting an account Client authorizes Provider to act within the scope of the permissions granted, and represents that Client has authority to grant them — for example, that Client is an administrator of each Facebook Page it links.

For Meta (Facebook / Instagram), the permissions Provider's app holds are exactly these seven, and what each is for:

  pages_show_list             — list the Pages Client administers, so Client can choose which to connect
  pages_manage_posts          — publish and schedule the posts Client approved
  pages_read_engagement       — read reach and engagement on published posts, for Client's own reporting
  instagram_basic             — read the Instagram Business account linked to a connected Page
  instagram_content_publish   — publish approved posts to Instagram
  business_management         — read which Business owns a connected Page
  public_profile              — basic profile of the connecting user; required by Meta for this class of app

Provider accesses only the accounts Client connects, and only to perform this service. This list is exhaustive: Provider will notify Client in writing before requesting any additional permission.

Client may disconnect any account at any time from the dashboard, or revoke Provider's access from the platform directly. On disconnection Provider deletes stored access tokens and ceases publishing to and reading from that account.

Client remains responsible for complying with each connected platform's own terms (including Meta's Platform Terms and Community Standards), and remains the owner and operator of its own accounts at all times.

5. REVIEW AND APPROVAL — NOTHING PUBLISHES WITHOUT CLIENT'S SAY-SO

By default, EVERY piece of content is drafted for Client's review and publishes only on Client's approval in the dashboard. This is the Maximus counterpart to "nothing merges without a person."

Client may explicitly opt in to automatic publishing per channel. Where Client does, Client accepts that content posted automatically may occasionally need correction after the fact, and Provider will correct or remove any post at Client's request as soon as reasonably possible. Provider records each automatic-publishing election — who made it, when, and for which channel — and Client may withdraw it at any time in the dashboard. Provider does not warrant that AI-generated content is free of errors (MSA §7.4); Client is responsible for reviewing content it approves, and for content published under an auto-publish election it made.

Provider will not publish content that is unlawful, deceptive, or in violation of a connected platform's standards, and may decline to publish specific content on those grounds, telling Client why. Provider does not fabricate reviews, testimonials, or endorsements: testimonial content is drafted only from genuine customer statements Client supplies and warrants as real. Provider does not draft content using a real individual's name, image, or likeness except individuals Client supplies with authority to use them.

6. WHAT CLIENT OWNS

Content Maximus produces for Client's business is a Deliverable: Client owns it FROM CREATION under MSA §4.1 — not on delivery, not on payment — and may use, modify, and distribute it freely. Provider's tools, prompts, templates, and systems remain Provider IP (MSA §4.2). Provider may reference its work for Client in its portfolio and marketing unless Client withdraws that in writing (MSA §17).

7. COMPETITIVE INTELLIGENCE

Where a package includes competitor intelligence, reports are generated from publicly available information only. Provider does not access private or proprietary data of any third party, and reports are informational — they are not professional, legal, or financial advice.

8. REPORTING

Client's dashboard shows what was drafted, approved, published, and how it performed (reach and engagement metrics as the connected platforms report them). Where a platform does not supply a metric for a period, the report says so; Provider does not estimate or fill gaps.

9. PLATFORM DEPENDENCE — THE HONEST CAVEAT

Maximus operates through APIs owned by the platforms (Meta, LinkedIn, and others), whose availability, behavior, rate limits, and policies change without notice. Provider is not responsible for platform outages, API changes, or enforcement actions a platform takes against Client's accounts, and does not warrant uninterrupted operation of any third-party platform (MSA §7.3). Where a platform change materially reduces what the Package can deliver, Provider will tell Client in writing what changed, and Client may adjust its Package or cancel under MSA §11.1.

10. SUSPENSION, CANCELLATION, AND WHAT CLIENT KEEPS

If a subscription charge fails, Provider may suspend the service, including drafting and publishing, until payment is current (MSA §2.4). Suspension is not termination.

Client may cancel at any time (MSA §11.1). Service continues through the end of the billing period Client has paid for and stops at that date — no notice period, no cancellation fee, no partial-period refund. [This replaces the fourteen-day notice term in the retired Maximus platform Terms of Service for every client papered on this document.]

On cancellation: content already produced is already Client's (Section 6). Within five (5) business days of the end date Provider delivers any content drafted but not yet published, disconnects and deletes Client's stored social tokens, and deletes Client's profile, content queue, and analytics snapshots within thirty (30) days except where law requires retention. Client's social accounts were never Provider's, and nothing about them changes.

11. PRECEDENCE

This Service Description supplements the MSA and the applicable SOW. If it conflicts with the MSA, the MSA controls. If it conflicts with the SOW, the SOW controls.
